How to talk about HSA/FSA payments

Unlike the pharmaceutical space, HSA/FSA marketing isn’t tightly regulated — but that doesn’t mean anything goes. The IRS has issued alerts around misleading messaging, especially when products are not always eligible or require special documentation to qualify.

1. Always eligible

Products that are always eligible are defined by IRS guidelines as medical expenses that don’t require additional documentation to qualify. These typically include:

  • Eyeglasses
  • OTC medications
  • Feminine hygiene products
  • Medical devices
  • Sunscreen

These products can confidently be marketed as “HSA/FSA eligible.” Just make sure this messaging only appears alongside qualifying SKUs if your catalog includes a mix.

2. Dual use

Dual use products may qualify for HSA/FSA use, but only with a Letter of Medical Necessity (LOMN). These are products that support health and wellness but also have a medical application. Examples include:

  • Exercise programs or equipment
  • Orthopedic footwear
  • Certain types of apparel or recovery products

If you offer dual use products, your messaging should make it clear that only qualifying customers can use HSA/FSA funds. Eligibility is determined through a clinical assessment — which Flex provides via telehealth during checkout.

For headlines, you can also use “HSA/FSA Eligible*” with a footnote or tooltip linking to more information about who qualifies.

For both categories, we recommend creating a simple landing page or adding a few FAQs to help customers understand how HSA/FSA payments work and what qualifies.
